SPOTTER Terms of Use

Athletic Insights, Inc. | Effective: 19 October 2026

1. Acceptance and eligibility

By creating an account or using SPOTTER, you agree to these Terms and our Privacy Policy. You must be at least 18 years old. If you are under 18, do not use SPOTTER. By using it, you confirm you are 18 or older and legally able to enter this agreement. If you do not agree, do not use SPOTTER.

2. Educational use only; not medical advice

SPOTTER provides general training feedback for educational purposes only. It is not medical advice, and it does not diagnose, treat, or prevent any injury or condition. It is not a substitute for a qualified coach, clinician, or other professional. Feedback may be inaccurate, incomplete, or unsuited to your body, and we do not guarantee its accuracy. Consult a qualified professional before starting any exercise program, and stop immediately if you feel pain or discomfort.

3. Assumption of risk and release

Physical exercise, including weightlifting and squatting, carries inherent risk of injury, including serious injury or death. You voluntarily assume all such risks. You are solely responsible for your health, your technique, your equipment, your exercise environment, and your decisions to follow or ignore SPOTTER's feedback. To the fullest extent permitted by law, you release Athletic Insights, Inc. and its officers, employees, and affiliates from any claims arising from your use of SPOTTER or your exercise activity.

4. Video and privacy

Uploading video is optional and controlled in Profile settings, as described in the Privacy Policy.

5. Your account

Keep your credentials secure. You are responsible for all activity under your account and must notify us promptly of unauthorized use. You must provide accurate information.

6. Acceptable use

You may not misuse SPOTTER, reverse engineer or copy it, interfere with its operation, access it by unauthorized means, or use it in violation of law.

7. Our rights and your content

SPOTTER and all related software, models, and materials are owned by Athletic Insights, Inc. and its licensors. We grant you a limited, revocable, non-transferable license to use SPOTTER for personal, non-commercial purposes. You retain ownership of your content, and you grant us a license to host, process, and use it to provide, maintain, and improve SPOTTER as described in the Privacy Policy.

8. No government affiliation

SPOTTER is a product of Athletic Insights, Inc. It is not endorsed by, affiliated with, or an official product of the U.S. Department of Defense, any military branch or unit, or any other government agency. Use of SPOTTER does not constitute official training guidance.

9. Disclaimer of warranties

SPOTTER is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that SPOTTER will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the fullest extent permitted by law, Athletic Insights, Inc. is not liable for indirect, incidental, special, consequential, or punitive damages, or for personal injury, lost data, or lost profits, arising from your use of SPOTTER. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or $100.

11. Indemnification

You agree to defend and indemnify Athletic Insights, Inc. and its officers, employees, and affiliates against claims, losses, and expenses (including reasonable attorneys' fees) arising from your use of SPOTTER, your content, or your violation of these Terms.

12. Termination

We may suspend or terminate your access at any time, with or without notice, including for violation of these Terms. You may stop using SPOTTER and delete your account at any time. Sections that by nature should survive (including 3, 9, 10, 11, 13, and 14) will survive.

13. Governing law and disputes

These Terms are governed by the laws of Delaware, without regard to conflict-of-law rules, and by the Federal Arbitration Act. Any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in the county where you live, or by video or phone if you prefer. You waive any right to a jury trial and to participate in a class or representative action. Either party may bring individual claims in small-claims court. You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@athleticinsights.io with the subject “Arbitration opt-out.”

14. Apple

If you downloaded SPOTTER from the Apple App Store, these Terms are between you and Athletic Insights, Inc., not Apple. Apple has no obligation to provide support or maintenance, and Apple is a third-party beneficiary of these Terms.

15. General

These Terms and the Privacy Policy are the entire agreement between us. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. We may update these Terms, and continued use after notice means you accept the changes. Contact: support@athleticinsights.io.
